News Laws and Ordinances

The Board of Directors of the Las Gallinas Valley Sanitary District of Marin County,Californiadoes ordain as follows:

WHEREAS, Ordinance No. 103 provides for the sewer connection cost per Equivalent Dwelling Unit (EDU) for different User Categories; and

WHEREAS, Ordinance No. 103 also provides for the sewer connection cost of Additions or Alterations to existing uses at the rate of 0.05 of an EDU per Plumbing Fixture Unit (PFU) added; and

WHEREAS, the Board of Directors of the Las Gallinas Valley Sanitary District wish to change the aforementioned “0.5 of an EDU rate per Plumbing Fixture Unit added” to make the District rate more consistent with the rates charged by other Marin County sanitary agencies; and

WHEREAS, the Board has surveyed the existing building alterations/additions sewer connection fees of other Marin County districts and wishes to replace Ordinance 103, Section 807, Subsection B (5);

NOW, THEREFORE, the Board of Directors of the Las Gallinas Valley Sanitary District repeals Subsection B (5) of Section 807 of Ordinance 103 and approves the following:

1.   Additions or alterations of existing structures (other than high-flow or high-strength) shall be charged a sewer connection fee (sometimes referred to as a Wastewater Capital Facilities Charge) and be subject to additional conditions of connection in accordance with the following:

(1)   Connection fee charge of seventy five (75) dollars per Plumbing Fixture Unit (PFU) added.

(2)   Any new section of sewer lateral added to accommodate a structure addition or alteration shall be built to District Plans and Specifications and shall be inspected by the District.

(3)   Should the existing structure not have a cleanout near the sewer exit point of the structure, a cleanout shall be installed by the property owner and inspected by the District.

(4)   The District will install a backflow prevention device at District cost at an elevation that will prevent structure sewage flooding at the lowest floor including the garage floor (see attached exhibit).

(5)   The Property owner, upon District installation of the backflow prevention device, shall own the backflow prevention device and its maintenance and replacement shall be the sole obligation of the property owner and any successor in interest.

(6)   District actions taken pursuant to this ordinance are only subject to appeal to the District Manager, or the District Superintendent in the absence of the District Manager.

Notes:

a) * If less then 6 inches between lowest plumbing fixture and backflow prevention device.

 b) District Standard Plan SD6 provides for mandatory installation of a Backflow Prevention Device and, in certain situations, an additional Backflow Check Valve (SD7) on all new sewer laterals, at the cost of the building permit applicant.  This Ordinance extends the mandatory installation requirement of a backflow prevention device and backwater check valve (if needed*) to alterations/additions of existing structure building permits when Plumbing Fixture Units (PFU’s) are being added to the structure.

2.   Upon adoption of this Ordinance, it shall be entered in full in the minutes of the Board of Directors, shall be posted in three (3) places in the District, shall be published once in the Marin Independent Journal, and shall take effect immediately upon the expiration of one (1) week of said publication and
